Terms of Service

Terms and conditions for using the Advantage Pools and Hot Tubs website and purchasing our products in Canada.

1. Agreement to Terms

By accessing or using the Advantage Pools and Hot Tubs website at advantagepoolsandhottubs.com (“Site”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site or our online ordering services.

These Terms apply together with our Privacy Policy, Shipping Information, Returns and Refunds, and Warranty Information. If there is a conflict between these Terms and a more specific policy page about shipping, returns, or warranty, the specific policy page controls for that subject.

2. Eligibility and Acceptable Use

Eligibility

You must be at least the age of majority in your province or territory of residence (18 in Alberta) to place orders or create an account. By using the Site, you represent that you meet this requirement.

Prohibited activities

You may not use the Site for unlawful purposes, attempt to gain unauthorized access to our systems, interfere with Site operation, scrape or harvest data without permission, or submit false or misleading order or contact information.

3. Accounts

You may browse much of the Site without an account. An account is required for certain features, such as saved addresses and online return requests. Accounts are authenticated through Clerk. You are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly if you suspect unauthorized access.

4. Products, Pricing, and Orders

  • All prices are shown in CAD unless stated otherwise.
  • Applicable Canadian sales taxes (GST, HST, PST, or QST) are calculated at checkout based on your delivery address and shown as a separate line item before you pay.
  • Product descriptions, images, specifications, and availability are subject to change without notice. We try to display colours and dimensions accurately, but minor variations may occur.
  • Placing an order is an offer to purchase. We may accept or decline any order (for example, due to stock limitations, pricing errors, suspected fraud, or shipping restrictions). A contract is formed when we confirm your order or ship the goods, whichever occurs first.
  • We reserve the right to correct pricing or typographical errors and to cancel orders affected by such errors, with a full refund of amounts charged.
  • We may limit quantities or refuse sales to any person, region, or jurisdiction where delivery is impractical or prohibited.

5. Payment

Online payments are processed by Stripe. By submitting payment information, you authorize us (through Stripe) to charge the total shown at checkout, including product subtotal, shipping, and applicable taxes. You represent that you are authorized to use the payment method provided. We do not store full credit card numbers on our servers.

6. Shipping and Delivery

Shipping options, rates, processing times, free-shipping thresholds, local pickup eligibility, and delivery exclusions are described on our Shipping Information page. Risk of loss for shipped goods passes to you upon delivery to the carrier, except where mandatory consumer protection law provides otherwise. Inspect shipments on arrival and report damage promptly as described on our shipping and returns pages.

7. Returns and Refunds

Returns are subject to our Returns and Refunds policy. In summary, eligible unopened merchandise may be returned within 15 days of delivery with a valid RMA. Restocking fees, non-returnable categories, custom cover rules, and refund timing are set out on that page. Statutory rights that cannot be waived under the Consumer Protection Act (Alberta) or other applicable law are not affected.

8. Warranty

Product warranties — including manufacturer coverage, store commitments, exclusions, and claim procedures — are described on our Warranty Information page. Warranty terms vary by product and brand. Nothing in these Terms limits warranty rights expressly provided by the manufacturer or required by law.

9. Intellectual Property

The Site and its content — including text, graphics, logos, product photography, layouts, and software — are owned by or licensed to Advantage Pools and Hot Tubs and protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may view and print pages for personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written consent.

10. Third-Party Links and Services

The Site may link to third-party websites or integrate third-party services (such as payment, shipping, and analytics providers). We are not responsible for the content or privacy practices of third parties. Your use of those services may be governed by their own terms.

11. Disclaimer of Warranties

Except as expressly stated on the Site, in product documentation, or in our warranty policies, the Site and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free.

Implied warranties and conditions that cannot be excluded under the Consumer Protection Act (Alberta) or other applicable law continue to apply.

12. Limitation of Liability

To the fullest extent permitted by applicable law in Alberta, Advantage Pools and Hot Tubs and our directors, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from your use of the Site or any products purchased through it.

Our total liability for any claim arising out of or relating to these Terms or a product purchased through the Site is limited to the amount you paid for the product giving rise to the claim, except where a greater limit is required by law.

Nothing in these Terms excludes or limits liability for gross negligence, fraud, personal injury caused by our negligence, or any other liability that cannot be excluded or limited under the Consumer Protection Act (Alberta) or other applicable law.

13. Indemnity

You agree to indemnify and hold harmless Advantage Pools and Hot Tubs from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site, or violation of any law or third-party rights, except to the extent caused by our own negligence or misconduct.

14. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

You agree that the courts of Alberta have exclusive jurisdiction over disputes arising from these Terms or your use of the Site, except where mandatory consumer protection rules in your province of residence provide otherwise.

15. General

  • Entire agreement — These Terms, together with the policies linked above, constitute the entire agreement between you and us regarding the Site.
  • Severability — If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver — Our failure to enforce a provision is not a waiver of that provision.
  • Assignment — We may assign these Terms in connection with a merger, sale, or reorganization. You may not assign your rights without our consent.
  • Changes — We may update these Terms from time to time. Continued use of the Site after the “Last Updated” date constitutes acceptance of the revised Terms.
